Unitholder update – 23/12/2021

In 2021 Trilogy Funds commenced proceedings as the trustee and responsible entity of the Pacific First Mortgage Fund (“the Fund”) against CBRE in relation to an allegedly negligent property valuation by CBRE, which Trilogy Funds alleges caused loss to the Fund. CBRE sought summary dismissal of the 2021 Proceedings. Recently, Trilogy Funds was successful against CBRE in the recent Court of Appeal proceedings which has resulted in Trilogy Funds being able to continue its claim against CBRE.

Trilogy Funds has filed its claim and the matter will be set down for further directions when the court re-commences in February 2022.
